These Terms of Service (“Terms”) govern your use of the website natanails.art (the “Site”) and the nail care and foot care services (“Services”) provided by Alyaba Company Inc, doing business as Nata Nails (“Company,” “we,” “us,” or “our”), at 4701 Von Karman Ave, Suite 200A, Newport Beach, CA 92660.

By using our Site, booking an appointment, or receiving our Services, you (“Client,” “you,” or “your”) acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree, do not use our Site or Services.

You must be at least 18 years of age to book an appointment or receive our Services. We do not provide services to minors (anyone under 18). By booking an appointment, you confirm that you are at least 18 years old. We reserve the right to request valid photo identification to verify your age and may refuse service if you are unable to provide proof that you are 18 or older.

These Terms constitute a legally binding agreement between you and Alyaba Company Inc.

  1. Nature of Services

Alyaba Company Inc, d/b/a Nata Nails, provides cosmetic and wellness nail care and foot care services, including but not limited to: manicure, pedicure, gel nail application and removal, nail art, nail repair, cuticle care, callus removal, medical pedicure, and men’s pedicure.

Service providers: Services may be performed by the studio owner or by independent contractors (1099) operating under their own licenses and professional credentials. All service providers at Nata Nails hold valid California state licenses for their respective services.

Independent contractor disclaimer: Certain services, including but not limited to medical pedicure, may be performed by licensed independent contractors who are not employees of Alyaba Company Inc. These contractors maintain their own professional licenses, carry their own insurance, and are independently responsible for the services they provide. While we carefully select and vet all contractors who operate in our studio, Alyaba Company Inc does not assume liability for the acts, omissions, negligence, or malpractice of independent contractors. Any claims arising from services performed by an independent contractor should be directed to that contractor. We will provide contractor identification and contact information upon written request.

OUR SERVICES ARE COSMETIC AND WELLNESS-ORIENTED IN NATURE. THEY ARE NOT MEDICAL SERVICES AND DO NOT CONSTITUTE MEDICAL ADVICE, MEDICAL DIAGNOSIS, OR MEDICAL TREATMENT. While our medical pedicure is performed by a trained and licensed podologist, it is a cosmetic and wellness foot care procedure — it is not a substitute for examination, diagnosis, or treatment by a licensed physician, podiatrist, or other healthcare provider.

If you have a medical condition that requires diagnosis or treatment, you must consult a licensed healthcare provider. We do not diagnose medical conditions. We do not prescribe medications. We do not provide medical advice. Any information we provide about foot health or nail conditions is for general informational purposes only and should not be relied upon as medical guidance.

  1. Appointments & Scheduling
  • All services are by appointment only. Walk-ins are not accepted.
  • Appointments can be booked online, by phone, by text, or through third-party platforms.
  • By booking an appointment, you confirm that you have read and agree to these Terms.
  • We reserve the right to reschedule or cancel any appointment at our sole discretion, for any reason, including but not limited to staffing, equipment, safety concerns, or client conduct. We will make reasonable efforts to notify you in advance.
  1. Cancellation, Late Arrival & No-Show Policy

Cancellations:

  • We require at least 24 hours notice for cancellations or rescheduling.
  • Late cancellations (less than 24 hours before scheduled appointment) may be subject to a cancellation fee of up to 100% of the scheduled service price.

Late arrivals:

  • If you arrive more than 15 minutes late to your scheduled appointment, we reserve the right to:
    • Shorten your service to fit within the remaining time (with adjusted pricing at our discretion)
    • Cancel your appointment entirely and charge a no-show fee of up to 100% of the scheduled service price
  • We cannot guarantee that late arrivals will be accommodated, as it may affect appointments scheduled after yours.
  • If you know you will be late, please call or text us as soon as possible — we will do our best to accommodate you, but cannot make guarantees.

No-shows:

  • No-shows (failure to arrive without notice) may be subject to a fee of up to 100% of the scheduled service price.
  • Repeated late cancellations or no-shows (2 or more) may result in:
    • Requirement of a non-refundable deposit for all future bookings
    • Temporary or permanent refusal of future appointments
  • We reserve the right to modify this policy at any time.
  1. Pricing, Payment & Deposits

Pricing:

  • All prices are listed on our website and are subject to change without prior notice.
  • Prices listed as “from” represent starting prices. Final pricing may vary based on nail condition, service complexity, additional time required, or add-on services requested.
  • We will communicate final pricing before the service begins. Proceeding with the service after being informed of the price constitutes acceptance of that price.

Payment:

  • We accept cash, major credit cards (processed through Square), Apple Pay, Google Pay, and Zelle.
  • Payment is due in full at the time of service unless otherwise agreed in writing.
  • Tips are appreciated but not required.
  • For returned payments, bounced checks, or disputed charges that are resolved in our favor, you agree to pay all associated fees and costs, including bank fees and collection costs.

Deposits:

  • We may require a non-refundable deposit at the time of booking to secure your appointment. The deposit amount will be communicated at the time of booking.
  • Deposits are applied toward the total cost of your service.
  • If you cancel with at least 24 hours notice, your deposit may be applied to a rescheduled appointment at our discretion.
  • If you cancel with less than 24 hours notice, fail to arrive (no-show), or arrive more than 15 minutes late and the appointment is cancelled — your deposit is forfeited and non-refundable.
  • Clients with a history of late cancellations or no-shows may be required to pay a deposit for all future bookings.

Gift Cards:

  • Gift cards are available for purchase and may be used toward any service at Nata Nails.
  • Gift cards are non-refundable and non-exchangeable for cash, except where required by California law (balances under $10 are redeemable for cash per California Civil Code § 1749.5).
  • Gift cards do not expire.
  • Gift cards have no service fees.
  • Lost, stolen, or damaged gift cards will not be replaced unless proof of purchase is provided, at our sole discretion.
  • Gift cards are not valid for tips.
  • We reserve the right to refuse gift cards that we believe to be fraudulent, duplicated, or obtained through unauthorized means.
  1. Client Health Disclosure & Responsibility

YOU ARE SOLELY RESPONSIBLE FOR INFORMING US OF ANY AND ALL HEALTH CONDITIONS, ALLERGIES, MEDICATIONS, SKIN CONDITIONS, OR MEDICAL CONCERNS THAT MAY AFFECT THE SAFETY OR SUITABILITY OF OUR SERVICES — BEFORE THE SERVICE BEGINS.

This includes but is not limited to:

  • Diabetes (Type 1 or Type 2)
  • Blood clotting disorders or use of blood thinners (e.g., Warfarin, aspirin therapy)
  • Circulatory or vascular conditions (e.g., peripheral neuropathy, Raynaud’s disease)
  • Skin conditions (eczema, psoriasis, dermatitis, open wounds, cuts, active infections)
  • Allergies or sensitivities to nail products, adhesives, chemicals, latex, or fragrances
  • Fungal infections of nails or skin
  • Bacterial infections or viral warts on hands or feet
  • Pregnancy or nursing
  • Immunocompromised conditions (e.g., HIV/AIDS, chemotherapy, organ transplant medications)
  • Autoimmune disorders
  • Recent surgeries or injuries on hands, feet, or nails
  • Any condition that affects sensation, healing, or blood flow in hands or feet
  • Any medication that affects skin sensitivity, bleeding, or immune response
  • Any condition that has been previously treated by a physician related to your nails or feet
  • Any other condition that a reasonable person would consider relevant to nail or foot care services

FAILURE TO DISCLOSE RELEVANT HEALTH INFORMATION RELEASES US FROM ALL LIABILITY FOR ANY ADVERSE OUTCOME RELATED TO THE UNDISCLOSED CONDITION. We rely on your honest and complete disclosure to provide safe and appropriate services. We are not medical professionals and cannot independently diagnose or detect health conditions.

We reserve the right to:

  • Ask health-related questions before any service
  • Require you to complete a written health intake form before your first appointment or at any subsequent visit
  • Refuse, modify, or discontinue any service if we determine, in our sole professional judgment, that it may not be safe or appropriate for you based on the information available
  • Recommend that you consult a licensed healthcare provider before or after receiving our services
  1. Assumption of Risk

BY RECEIVING OUR SERVICES, YOU VOLUNTARILY ASSUME ALL RISKS ASSOCIATED WITH NAIL CARE AND FOOT CARE PROCEDURES.

You acknowledge and agree that:

  1. a) Nail care and foot care services — including but not limited to gel application and removal, e-file use, cuticle work, callus removal, nail shaping, medical pedicure treatments, and all other procedures performed at our studio — carry inherent risks that exist regardless of the skill, care, and precautions taken by the service provider. These inherent risks include but are not limited to:
  • Skin irritation, redness, swelling, or sensitivity
  • Allergic reactions to products, chemicals, adhesives, or materials (including reactions that may not have been previously known to you)
  • Minor cuts, nicks, or abrasions
  • Bruising or soreness
  • Nail thinning, weakening, or temporary damage
  • Cuticle irritation or sensitivity
  • Temporary or prolonged discomfort or pain
  • Ingrown nail development or recurrence
  • Infection (bacterial, viral, or fungal) — despite our sterilization protocols
  • Delayed healing
  • Scarring (in rare cases)
  • Exacerbation of pre-existing conditions
  • Adverse reactions that may occur hours or days after the service
  1. b) Results vary from person to person depending on individual nail and skin condition, genetics, health factors, lifestyle, occupation, aftercare compliance, and environmental factors. WE DO NOT GUARANTEE SPECIFIC RESULTS, DURATION OF WEAR, APPEARANCE, OR OUTCOMES OF ANY SERVICE.
  2. c) You have had the opportunity to ask questions about the services, techniques, products used, and associated risks before proceeding, and you are satisfied with the information provided.
  3. d) You are voluntarily choosing to receive our services with full knowledge of the inherent risks described above.
  4. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY THE LAWS OF THE STATE OF CALIFORNIA:

  1. a) Alyaba Company Inc (d/b/a Nata Nails), its owner, officers, directors, shareholders, employees, independent contractors, agents, and assigns (collectively, “Released Parties”) SHALL NOT BE HELD LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING FROM OR RELATED TO:
  • The Services provided or any failure to provide Services
  • Allergic reactions to any products, chemicals, or materials used during service — whether known or unknown to you
  • Skin irritation, redness, sensitivity, swelling, or discomfort of any kind
  • Any infection (bacterial, viral, or fungal) that develops during or after service, regardless of cause
  • Nail damage, thinning, breakage, discoloration, or weakening
  • Ingrown toenail development, recurrence, or complications
  • Callus-related complications
  • Cracked, dry, or irritated skin on hands or feet
  • Any exacerbation or worsening of pre-existing conditions — whether disclosed or undisclosed
  • Any adverse outcome resulting from your failure to disclose health information
  • Any adverse outcome resulting from your failure to follow aftercare instructions
  • Dissatisfaction with cosmetic results, including color, shape, design, duration of wear, or overall appearance
  • Damage to natural nails caused by gel removal (whether performed by us or self-removed by you)
  • Any condition, injury, or illness that manifests or is discovered after your appointment
  • Loss of income, loss of enjoyment, emotional distress, or any other consequential damages
  • Any third-party services performed on your nails or feet after your appointment at Nata Nails
  • Your use of our website, reliance on information published on our website, or any technical issues with the Site
  • Acts, omissions, negligence, or malpractice of independent contractors operating at our studio — such claims should be directed to the individual contractor (see Section 1)
  1. b) IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY FOR ANY AND ALL CLAIMS ARISING FROM OR RELATED TO OUR SERVICES EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM. This limitation applies to all claims, regardless of the legal theory (contract, tort, negligence, strict liability, warranty, or otherwise).
  2. c) These limitations apply even if we have been advised of the possibility of such damages and regardless of whether the damages arise from breach of contract, breach of warranty, tort (including negligence), strict liability, or any other legal theory.
  3. d) You acknowledge that the pricing of our services reflects this allocation of risk and that without these limitations, the pricing of our services would be substantially higher.
  4. Waiver of Claims

BY RECEIVING OUR SERVICES, YOU WAIVE, RELEASE, AND FOREVER DISCHARGE THE RELEASED PARTIES (as defined in Section 7) FROM ANY AND ALL CLAIMS, DEMANDS, ACTIONS, CAUSES OF ACTION, SUITS, DAMAGES, LOSSES, AND LIABILITIES OF EVERY KIND AND NATURE, WHETHER KNOWN OR UNKNOWN, ARISING FROM OR RELATED TO OUR SERVICES, including but not limited to claims of negligence, gross negligence (to the extent permitted by law), breach of warranty, product liability, or any other legal theory.

CALIFORNIA CIVIL CODE SECTION 1542 WAIVER: You expressly waive and relinquish all rights and benefits under California Civil Code Section 1542, which provides:

“A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”

You understand that you may discover facts different from or in addition to those that you now know or believe to be true regarding the subject matter of this release, and you agree that this release shall remain in full force and effect notwithstanding the discovery of such facts.

  1. Aftercare Responsibility

Following your appointment, you may receive aftercare instructions verbally, in writing, or electronically. YOU ARE SOLELY RESPONSIBLE FOR FOLLOWING ALL AFTERCARE RECOMMENDATIONS.

We are not liable for any adverse outcomes resulting from your failure to follow aftercare instructions, including but not limited to:

  • Premature gel lifting, chipping, or peeling due to improper use of hands or nails
  • Nail damage from self-removal of gel polish, acrylic, or other nail products
  • Infection, irritation, or complication caused by post-service contact with unsanitary conditions, chemicals, or environments
  • Failure to keep treated areas clean and dry as instructed
  • Failure to apply recommended products or treatments
  • Failure to seek medical attention when recommended or when symptoms develop
  • Any damage resulting from exposure to water, chemicals, heat, or physical trauma after service
  • Any damage resulting from services performed by other nail technicians or salons after your appointment with us
  1. Refund & Correction Policy
  • WE DO NOT OFFER MONETARY REFUNDS FOR COMPLETED SERVICES UNDER ANY CIRCUMSTANCES.
  • If you are not satisfied with your service, you must contact us within 48 hours of your appointment.
  • We will evaluate the concern and, at our sole and absolute discretion, may offer a complimentary correction or adjustment at a time convenient for both parties.
  • Corrections are available only for demonstrable defects in the original service — changes in color preference, design preference, shape preference, or style preference are not considered defects and may be subject to additional charges at standard rates.
  • We are not responsible for damage caused by any third-party services performed after your appointment at Nata Nails.
  • Filing a credit card chargeback or payment dispute for a completed service that was delivered as described will be considered a breach of these Terms. We reserve the right to pursue all available remedies, including but not limited to collection fees, legal fees, and refusal of future services.
  1. Photography, Content & Intellectual Property

By receiving our Services, you grant Alyaba Company Inc (d/b/a Nata Nails) the following rights regarding photography and content:

  1. a) We may photograph and/or video record our work — including but not limited to your nails, hands, feet, and the process of service delivery — during or after your appointment.
  2. b) You grant us a perpetual, irrevocable, worldwide, royalty-free, transferable license to use, reproduce, modify, distribute, display, and create derivative works from these photographs and videos for any purpose, including but not limited to:
  • Our website (natanails.art)
  • Social media accounts (Instagram, Facebook, TikTok, Pinterest, YouTube, and any future platforms)
  • Google Business Profile
  • Advertising and marketing materials (online and print)
  • Portfolio and promotional content
  • Press and media use
  • Third-party review sites and directories
  • Any other business or commercial purpose
  1. c) Photos will not include your face unless you provide separate, explicit written consent. Close-up photos of nails, hands, and feet do not require additional consent beyond these Terms.
  2. d) If you do not wish to have your nails photographed at all, you must inform your specialist before the service begins. Verbal opt-out at the start of the appointment will be honored for that specific visit. Failure to opt out constitutes consent to photography for that visit.
  3. e) You waive any right to inspect or approve the finished photographs, videos, or any content created from them before they are published or used.
  4. f) You waive any right to compensation for the use of photographs or videos of your nails, hands, or feet.
  5. g) You release the Released Parties from any claims arising from the use of photographs or videos, including but not limited to claims of invasion of privacy, right of publicity, defamation, or copyright infringement.
  6. h) All content on our Site and social media — including text, images, logos, designs, photographs, videos, and service descriptions — is the intellectual property of Alyaba Company Inc and is protected by copyright and intellectual property laws. You may not reproduce, distribute, modify, or use any content from our Site or social media without our prior written consent.
  7. i) User-generated content: If you post or share photos of our work on social media or review sites, you grant us the right to repost, share, or use that content on our platforms with credit to your account (unless you request otherwise).
  8. Communication & Marketing
  • By providing your phone number and/or email address, you consent to receive appointment-related communications (confirmations, reminders, cancellations, follow-ups) via phone, SMS, email, Facebook Messenger, or Instagram DM.
  • We may also send promotional and marketing communications — including special offers, new services, seasonal promotions, and business updates — via email, SMS, or other channels.
  • You can opt out of marketing communications at any time by replying STOP to any SMS, clicking “Unsubscribe” in any email, or contacting us directly. Opting out of marketing does not affect appointment-related or transactional communications.
  • By communicating with us through Facebook Messenger or Instagram DM, you acknowledge that these conversations are processed by Meta and subject to Meta’s privacy policy in addition to ours.
  • We reserve the right to contact you regarding unpaid balances, no-show fees, or other account-related matters regardless of your marketing opt-out status.
  1. Client Conduct

We are committed to providing a respectful, safe, and professional environment for our clients and staff.

  • We reserve the right to refuse, discontinue, or terminate service to any client who:
    • Behaves in a threatening, abusive, harassing, disrespectful, or disruptive manner
    • Arrives under the influence of alcohol or drugs
    • Is uncooperative during the service in a way that compromises safety or quality
    • Has a communicable condition that may endanger staff health
    • Repeatedly violates these Terms
  • Refusal or termination of service for any of the above reasons does not entitle you to a refund.
  • We reserve the right to permanently ban any client from future services at our sole discretion.
  • Any threats, harassment, or defamatory statements made against our business, staff, or contractors — whether in person, online, or through third parties — may result in legal action.
  1. Indemnification

You agree to indemnify, defend, and hold harmless Alyaba Company Inc (d/b/a Nata Nails), its owner, officers, directors, shareholders, employees, independent contractors, agents, and assigns from and against any and all claims, demands, actions, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees and legal costs) arising from or related to:

  • Your use of our Site or Services
  • Your violation of these Terms
  • Your failure to disclose relevant health information
  • Your failure to follow aftercare instructions
  • Any misrepresentation made by you regarding your health, identity, age, or eligibility for services
  • Any claim by a third party related to your use of our Services
  • Any dispute with your credit card company, bank, or payment provider related to charges for our Services
  • Any fraudulent use of gift cards or promotional offers
  • Any defamatory, harassing, or false statements you make about our business, staff, or contractors
  • Any claim arising from services performed by an independent contractor at our studio that is directed at Alyaba Company Inc rather than the individual contractor
  1. Dispute Resolution & Arbitration

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.

  1. a) Any dispute, claim, or controversy arising from or related to these Terms, our Services, our Site, or any aspect of your relationship with Alyaba Company Inc (d/b/a Nata Nails) — whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory — shall first be attempted to be resolved through good-faith negotiation by contacting us directly.
  2. b) If negotiation fails within 30 days, the dispute shall be resolved through final and binding arbitration administered by JAMS (Judicial Arbitration and Mediation Services) or the American Arbitration Association (AAA) in Orange County, California, in accordance with their applicable rules.
  3. c) YOU AGREE TO WAIVE YOUR RIGHT TO A TRIAL BY JURY.
  4. d) YOU AGREE TO WAIVE YOUR RIGHT TO PARTICIPATE IN ANY CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE ACTION AGAINST ALYABA COMPANY INC (D/B/A NATA NAILS). All claims must be brought in your individual capacity, not as a plaintiff or class member in any purported class or representative proceeding.
  5. e) The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
  6. f) Each party shall bear its own costs and attorneys’ fees in arbitration, except that the prevailing party may be entitled to recover reasonable attorneys’ fees and costs at the arbitrator’s discretion.
  7. g) Small claims exception: Either party may bring an individual action in small claims court in Orange County, California, if the claim falls within the court’s jurisdictional limits.
  8. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in Orange County, California, and you consent to the personal jurisdiction of such courts.

  1. Severability

If any provision of these Terms is found to be unenforceable, invalid, or prohibited by law, that provision shall be modified to the minimum extent necessary to make it enforceable, or if it cannot be modified, it shall be severed from these Terms. The remaining provisions shall continue in full force and effect. The unenforceability of any provision shall not affect the enforceability of any other provision.

  1. Entire Agreement

These Terms, together with our Privacy Policy (available at natanails.art/privacy-policy/) and any Client Intake Form or consent form you may sign, constitute the entire agreement between you and Alyaba Company Inc regarding your use of our Site and Services, and supersede all prior or contemporaneous agreements, representations, warranties, and understandings. In the event of a conflict between these Terms and a signed Client Intake Form, the more protective provision (from the Company’s perspective) shall control.

  1. No Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision. A waiver of any provision on one occasion shall not be construed as a waiver of that provision on any subsequent occasion.

  1. Changes to These Terms

We reserve the right to update, modify, or replace these Terms at any time at our sole discretion. Changes will be posted on this page with an updated “Last updated” date. Your continued use of our Site or Services after any changes constitutes your acceptance of the updated Terms. It is your responsibility to review these Terms periodically.
